SocialStache Terms of Service

These terms are an agreement between you and Fleek Consulting, LLC ("we," "us") covering your use of SocialStache at app.socialstache.ai. By creating an account you agree to them.

What SocialStache does

SocialStache generates social media content in your brand's voice, publishes it to social media accounts you connect, and lets you read and reply to comments on those posts.

Your account

You need to be at least 18 and using SocialStache for a business. You're responsible for keeping your login secure and for what happens under your account, including anything done by people you invite to it.

Give us accurate information when you sign up, and keep it current.

Brands, seats, and payment

Each brand is its own subscription. If you run several brands, each one is billed separately and you switch between them from a single login.

Price. $197 per month, or $167 per month on an annual plan billed at $1,997 per year. Billed in advance, renewing automatically until you cancel.

Team members. Each brand includes 3 seats. Additional seats are $29 per month each, added to that brand's subscription.

Money-back guarantee. If SocialStache isn't right for you, email us within 30 days of your first payment for a brand and we'll refund it in full. This applies to your first payment only, once per customer. Renewals aren't refundable. On an annual plan, the 30 days runs from your initial annual charge.

There is no free trial. The guarantee above is how you try it.

Switching between monthly and annual. Monthly to annual takes effect immediately: we charge the annual price, credit whatever unused time remains on your current month, and start the year from that point. Annual to monthly takes effect at the end of the year you've already paid for, since we don't refund unused annual time.

Cancelling. You can cancel at any time from your billing settings. You keep access until the end of the period you've already paid for, and it doesn't renew after that. We don't prorate or refund partial periods. Cancelling a brand works the same way, and is separate from deleting your account.

Price changes. If we change the price, we'll tell you at least 30 days before it affects you.

Usage limits

Each brand includes, every month:

• 500 AI generations. Each message you send in the chat counts as one, whether it produces a single caption or a whole week of posts. Revisions and regenerations count too, and the weekly automatic content runs draw from the same allowance. This resets on your billing date.
• 500 published posts. Everything SocialStache publishes for the brand — immediately or on a schedule — counts toward this, resetting on your billing date. It sits far above normal use: it exists to stop a runaway automation, not to meter your posting, and we'll warn you well before you reach it.
• 200 comment replies sent from the Inbox, resetting at the start of each calendar month.
• 90 older-post imports per connected social account, resetting at the start of each calendar month. This covers the "Check for older comments" feature, which fetches posts published before you connected an account.

Uploaded files are limited to 5GB each.

When you reach a limit, that feature pauses until the reset. Nothing is deleted, and content you've already created is unaffected. If these limits get in the way of ordinary use of the product, tell us.

Content generated by AI, and why you have to read it

This section matters more than any other in these terms. Please read it.

SocialStache uses AI to write content in your brand's voice. AI can get things wrong. It can state something about your business that isn't accurate, misremember a detail, or produce something that reads well but isn't true.

You are responsible for reviewing content before it publishes. The Review Queue exists for exactly this. If you approve a post, schedule it, or turn on automatic publishing, you are the publisher of that content and you are responsible for it.

We build safeguards to reduce invented details, and we'll keep improving them. We do not guarantee that generated content is accurate, appropriate for your audience, or compliant with the rules of your industry.

If your business is in a regulated field — healthcare, legal, financial services, or anything else with advertising rules — that review is your obligation, not ours, and we can't perform it for you.

Your content is yours

Anything you put into SocialStache, and anything it generates for you, belongs to you. We don't claim ownership.

We need your permission to operate the product — to store your content, send it to the AI that generates from it, and publish it to the accounts you connect. That permission covers running SocialStache for you and nothing else. We don't use your content to promote ourselves or anyone else without asking you first.

Social media accounts

When you connect a social media account, you're confirming you're allowed to post to it.

You also agree to follow the rules of each platform you connect. Instagram, Facebook, LinkedIn, X, TikTok, YouTube, Threads and any others each have their own terms, and those terms apply to you regardless of what tool you use to post.

We depend on those platforms and don't control them. They can change their rules, restrict what tools like ours can do, rate-limit us, or suspend accounts. When that happens we'll tell you what we know and work around it where we can, but we can't guarantee any platform will keep working, and we're not responsible when a platform restricts or removes your account or your posts.

What you can't do

Don't use SocialStache to:

• Publish content that is illegal, harassing, hateful, or deceptive
• Impersonate someone else, or post on behalf of a business without permission
• Break the rules of any platform you connect
• Interfere with the service, or try to access parts of it you're not entitled to
• Resell access to your account, or use it to run social media for clients unless we've agreed to that arrangement in writing

If you do any of this, we may suspend or close your account. Where it's reasonable to do so, we'll warn you first.

Availability

We work hard to keep SocialStache running, but we don't promise it will always be available. We may take it down for maintenance, and parts of it depend on other companies' services that we don't control.

Ending the agreement

You can close your account at any time.

We may close your account if you break these terms, if you don't pay, or if we stop offering the product. If we stop offering SocialStache, we'll give you reasonable notice and a way to export your content.

When a brand's subscription ends — because you cancelled, or because payment ultimately failed — the brand locks, but its content is kept for another 90 days. During that time you can export everything as a file from the screen the brand lands on, and resubscribing restores it exactly as you left it. We email you when the countdown starts and again a week before it ends. After the 90 days, that brand's content, files, and social connections are deleted permanently. If a payment fails, the countdown doesn't start until the card retries have run out.

When you delete your account, renewal turns off on every brand you own and a reactivation window starts: 30 days, or the rest of the time you've already paid for, whichever is longer. Signing back in during the window restores everything. When the window ends, your account and everything in it is deleted permanently.

Export first if you're leaving. You can download your content at any time from Settings, and export is offered again on the deletion and cancellation screens. Once a permanent deletion has run, we can't recover anything.

Legal

No warranties. SocialStache is provided as is. We don't warrant that it will be uninterrupted, error-free, or that it will produce any particular business result.

Limitation of liability. To the extent the law allows, our total liability to you for anything arising out of these terms is limited to what you paid us in the twelve months before the claim. We're not liable for lost profits, lost business, or indirect damages.

Indemnity. If someone brings a claim against us because of content you published through SocialStache, you agree to cover our reasonable costs in defending it.

Governing law. These terms are governed by the laws of the State of North Carolina, and any dispute will be brought in the state or federal courts located in Mecklenburg County, North Carolina.

Changes. If we change these terms materially, we'll email you before the change takes effect. Continuing to use SocialStache after that means you accept the new terms.
